Background

Gibran has five years’ post-admission experience in the areas of commercial, land based and public interest litigation in the Court of Appeal, High Court as well as the lower Kenyan courts. In transactional matters, he has hands-on experience in the handling of sale agreements and conveyance of large residential and commercial property development projects.

Top matters

  • Advising and acting for a Kenyan pension scheme in defending a judgement by the retirement benefits tribunal for the sum of in excess of KES 7 billion (USD 70 million) by former employees of Telkom Kenya limited as being the total of their unpaid retirement dues
  • Successfully prepared, argued and obtained judgment in favor of a client in a constitutional Petition filed against the Kenya National Highways Authority and the Chairman of the National Land Commission in the High Court
  • Prepared pleadings and argued a complex constitutional petition against the Director of Immigration and Foreign Nationals Management Service on the issue of the legal rights of a stateless individual under the Constitution and the Immigration and Foreign Nationals Management Act, (2014). It resulted in judgment in favor of our client
  • Engaged in a suit and application for interim injunctive relief in regard to a building contract for a hotel and resort valued at KES 1 billion (USD 10 million). Obtained injunctive orders against an internationally registered Company on behalf of our client, Continental Homes Limited, a reputed building contractor based in Malindi and handled the arbitration proceedings matter where an award of KES 40 million (USD 400,000) was given
  • Prepared and argued numerous applications in the Environmental & Land Division of the High Court and obtained interim injunctive orders for a client in the manufacturing industry under a Certificate of Urgency
  • Part of a team that represented a client (the plaintiff) in a defamation case which resulted in a favourable judgment and a KES 7 million (USD 70,000) award for our client
  • Prepared a research paper for a former Kenyan minister (in the Ministry of Justice and Constitutional Affairs) on among other things, the provision of abortions (one of the hotly debated topics at the time) as per the draft constitution ahead of Kenya’s landmark 2010 referendum
  • Carried out preparation and drafting of court applications, pleadings and authorities in Eurobank (liquidation) matters which resulted in favourable judgments for our client
  • Part of a team that prepared a petition to the East African Court of Justice on Human Rights relating to alleged offences carried out by the Kenyan Army in the Mount Elgon region, premised on a report by the Independent Medico Legal Unit
  • Part of a team that represented a client in an election petition relating to the Wajir South parliamentary seat
  • Prepared an opinion for Pioneer Holdings Limited (a Kenyan brokerage firm) on the viability of commencement of proceedings against the Nairobi Securities Exchange
  • Made a successful application on behalf of a client to strike out a Record of Appeal
