Claire is a Senior Associate in the Dispute Resolution department and specialises in litigation, arbitration and mediation. 

With over eight years’ experience, she has advised both local and international clients in arbitration, constitutional and human rights law, judicial review and administrative law, capital markets law, succession, mining, banking and finance, defamation, insolvency and bankruptcy, employment and labour law and land disputes.

Claire has been involved in various notable matters including being part of a team in a landmark constitutional law dispute at the Supreme Court of Kenya that successfully challenged the statutory overlap of the dual investigative and enforcement power of the Capital Markets Authority.

She holds a Master of Laws (LLM) degree from the University of Nairobi, where she specialised in International Trade and Investments Law. In addition, Claire is a holder of a Bachelor of Laws (LLB) degree from Moi University and a Post-graduate Diploma in Law from the Kenya School of Law. She is also a Certified Secretary and a member of the Institute of Certified Secretaries of Kenya (ICS).

Experience

Prior to joining Oraro & Company Advocates, Claire was involved in the following matters:

  • Part of a team working in a landmark Constitutional and Human Rights Petition at the Supreme Court of Kenya that successfully challenged the statutory overlap of the dual investigative and enforcement powers of the Capital Markets Authority.
  • Part of the team that acted in an arbitration for a leading parastatal in a case for breach of a construction contract in a claim and counterclaim amounting to over KES. 512 million.
  • Part of the team that successfully represented a creditor in a bankruptcy petition that resulted in the debtor being adjudged bankrupt for a debt of slightly over USD 5 million.
  • Part of the team that successfully represented the ex parte applicants against the Cabinet Secretary, Ministry of Mining and Commissioner of Mines & Geology in a Judicial Review matter that sought prerogative orders to quash the revocation of special mining licenses.
  • Part of the team that acted for a dependant in a succession matter seeking reasonable provision from the Estate of his deceased father in an estate worth over KES. 3 billion.
  • Part of the team that successfully represented a leading medical equipment supplier in obtaining mandatory injunctive orders against the largest media house in East and Central Africa for publication of a defamatory broadcast dubbed “COVID-19 Millionaires: Corruption and COVID-19 moving at the same pace.”

Daniel Kiragu is a Senior Associate in the Dispute Resolution practice group with over 5 years of experience advising and representing both local and international clients in a wide array of contentious and non-contentious matters.

His main areas of expertise include commercial litigation, criminal litigation, alternative dispute resolution, drafting advisory opinions, insolvency, banking, employment, land, family & succession law.

Some of the notable matters Daniel has been involved in include assisting in filing a successful petition objecting to the award of the tender for the printing of Kenya currency bank notes to an international company in a contract worth over USD 105 million.

Daniel holds a Bachelor of Laws (LLB) (Hons) from the University of Nairobi and a Post-graduate diploma in Law from the Kenya School of Law. He has also been trained on Trial Advocacy by the Inns of Court College of Advocacy (United Kingdom).

Experience

Prior to joining Oraro & Company Advocates, Daniel was involved in the following matters:

  • Assisted in filing a successful petition objecting to the award of the tender for the printing of Kenya currency bank notes to an international company in a contract worth over USD 105 million.
  • Part of the team that advised and represented a Dutch brewing company in connection with a disputed termination of distribution agreements in Kenya, Uganda and Tanzania. The value of the dispute in the 3 countries was approximately USD 30 million.
  • Acted for a major transport company in a variety of matters notably successfully objecting to the execution of over KES 526 million awarded to a worker’s union as compensation for redundancy.
  • Advised and successfully represented a client in a management agreement dispute with a club.
  • Successfully acted for a prominent accused person for actions done while executing duties when serving as a Cabinet Secretary in the Government of Kenya.
  • Part of the team that advised and represented an international construction company in opposing injunctive orders sought by a bank, restraining its group of companies located in several countries from disposing any of their assets/accounts in Kenya as well as opposing a mandatory injunction requiring all proceeds under the disputed agreement worth USD 52.3 million to be remitted to the bank.

Milly is a Senior Associate in the Corporate and Commercial practice group and specialises in corporate & commercial law, competition law, employment & labour law and intellectual property law. Milly has advised local and international clients on corporate restructurings, mergers & acquisitions, commercial contracts, drafting employment contracts, reviewing of employment policies & procedures, trademarks and copyrights.

Milly was part of a team that advised Equity Group Holdings Limited (formerly Equity Bank Limited) on a 79% stake of the of ProCredit Bank, a financial institution in the Democratic Republic of Congo, from Belgische Investeringsmaatschappij voor Ontwikkelingslanden, Stichting DOEN and ProCredit Holding AG. The acquisition required undertaking a comprehensive due diligence, drafting and reviewing of the share purchase agreement and undertaking the competition filings at the Competition Authority of Kenya.

Milly has a Bachelor of Laws (LLB) from Moi University and a post-graduate diploma in Law from Kenya School of Law.

  • Part of a team that advised Essar Overseas Energy Limited in connection with their sale of 50% stake in Kenya Petroleum Refineries Limited to the Government of Kenya, including assisting in drafting the agreements and the completion process.
  • Part of a team that advised Equity Group Holdings Limited (EGHL) (formerly Equity Bank Limited) on its acquisition of 79% of the share capital of ProCredit Bank, a financial institution in the Democratic Republic of Congo, from Belgische Investeringsmaatschappij voor Ontwikkelingslanden, Stichting DOEN and ProCredit Holding AG, including structuring the all stock consideration for the sale through issue and allotment of EGHL’s shares to each of the three sellers, undertaking due diligence on ProCredit Bank and addressing the multiple financial and competition regulatory challenges to the transaction.
  • Part of a team that assisted in undertaking due diligence and thus advising Godrej Consumer Products Limited on its proposed acquisition of a major stake in Canon Chemicals Limited.
  • Part of a team that assisted in advising Atlas Development and Support Services Limited (formally Africa Oilfield Logistics Limited), a company incorporated in the Island of Guernsey, Channel Islands and listed on the London Stock Exchange, on its cross-listing onto the Growth Enterprise Market Segment (GEMS) of the Nairobi Securities Exchange – the first ever successful cross-listing onto GEMS.
  • Assisted in advising clients in a variety of sectors on employment and labour related issues. The scope of work included drafting and developing a standard template for expatriates, senior local employees and junior local employees, drafting separation/settlement agreements and advising on dismissals and redundancies.
