BACKGROUND
Kelvin Jumah is an Associate in the Litigation Department. His practice focuses on commercial litigation with a speciality in tax law and public procurement law.
Drawing on his extensive experience with the Kenya Revenue Authority, Jumah has extensive experience in resolving tax disputes related to VAT, Income Tax, Excise Duty, Customs Duty, international taxation, disputes arising from tax administration. He has a proven track record of providing strategic legal counsel and achieving favourable outcomes for clients in complex, and high-stakes tax disputes including leveraging the Alternative Dispute Resolution program for client-centric outcomes. He also has a strong background in public procurement law, having gained valuable experience with the Public Procurement Administrative Review Board on the complexities of bid preparation, dispute resolution, and procurement contract management.
Kelvin holds a Bachelor of Laws (LLB) from the University of Nairobi, a postgraduate diploma in Law from the Kenya School of Law, and a Postgraduate Diploma in Tax Administration.
EXPERIENCE
- Part of the team that successfully litigated Income Tax and VAT assessments of USD 3,000,000 of a joint venture partnership from award public procurement contract funded via a grant.
- Part of the team that successfully litigated an exported services claim involving a multinational company offering digital services in the banking industry assessed at USD 2,500,000.
- Part of the team that advised on the constitutionality of tax provisions under the Finance Act 2023 and 2024, respectively.
- Part of the team that advised on the formulation, defence, and implementation the Affordable Housing Act.
- Part of the that litigated the awarded of USD 7,000,000 and USD70,000,000 construction and maintenance public procurement contracts in the energy sector.
