Clause 2

Amendment of section 25 of No. 18 of 2012

Section 25 of the Public Finance Management Act, 2012 in this Act referred to as the “principal Act” is amended:

a. in subsection (7) by deleting the word “fourteen” appearing immediately after the words “not later than” and substituting thereof the word “twenty-one”; and
b. in subsection (9) by deleting the word “fifteen” appearing immediately after the words “not later than” and substituting thereof the word “twenty-two”.

Currently, the Public Finance Management Act gives Parliament a period of fourteen days to discuss the Budget Policy Statement.

The Bill proposes to increase the period for consideration of the Budget Policy Statement from fourteen to twenty-one days.

The proposal is reasonable as it will give Parliament sufficient time to discuss and scrutinize the Budget Policy Statement.

For subsection (9), we propose the addition of the words “in the Kenya Gazette” immediately after the word “Statement”. This proposal seeks to provide clarity as the subsection has not indicated where the Budget Policy Statement would be published.
