BACKGROUND
Claire is a Partner at Oraro & Company Advocates in the Dispute Resolution department, specialising in litigation, corporate governance, arbitration, mediation, and intellectual property.
With over 13 years of experience, she has advised both local and international clients on a wide range of legal matters, including arbitration, constitutional and human rights law, judicial review and administrative law, capital markets law, succession, mining, banking and finance, defamation, insolvency and bankruptcy, corporate governance, employment and labour law, and land disputes.
Claire has played a key role in high-profile cases, including being part of a legal team that successfully challenged the statutory overlap of the dual investigative and enforcement power of the Capital Markets Authority in a landmark constitutional law dispute before the Supreme Court of Kenya.
She holds a Master of Laws (LLM) degree from the University of Nairobi, where she specialised in International Trade and Investments Law, a Bachelor of Laws (LLB) degree and a Postgraduate Diploma in Law from the Kenya School of Law. She is a practising Certified Secretary and a member of the Institute of Certified Secretaries of Kenya (ICS). In addition, Claire is an Accredited Legal and Compliance Auditor (LSK) and an Accredited Governance Auditor (ICS).
EXPERIENCE
- Part of a team that represented a party in a long-drawn-out litigation seeking prayers for satisfaction and discharge of a Decree that eliminated the client’s exposure exceeding the sum of KShs. 300 Million.
- Part of a team that represented APM Terminals BV at the Public Private Partnerships Petitions Committee at Nairobi in a Petition challenging the compliance of the Kenya Ports of Authority with the Public Private Partnerships Act 2021.
- Part of a team that represented a client in a claim for breach of a construction contract claiming inter alia, a sum of KShs.66,475,542.21 which was successfully settled by way of mediation.
- Part of team that represented a co-administrator in a contentious succession dispute that resulted in the successful confirmation of Grant.
- Part of a team that represented a leading telecommunication company in an employment dispute valued over USD443,000.00 that resulted in a successful Mediation Settlement Agreement.
- Part of a team in a landmark Constitutional and Human Rights Petition at the Supreme Court of Kenya that successfully challenged the statutory overlap of the dual investigative and enforcement powers of the Capital Markets Authority.
- Part of the team that successfully defended a client against its former employees in a claim for unpaid pension amounts at the Retirement Benefits Appeals Tribunal.
